SPRING GAME TERMS AND CONDITIONS

[Playtex UK SS23 Spring Game  Terms & Conditions]


ARTICLE 1: ORGANISATION OF THE GAME 

The company PW France with a share capital of €349,652, registered in the Nanterre Trade and Companies Register under number 602 046 864, whose registered office is located at 2 rue des Martinets, 92500 Rueil Malmaison, France (hereinafter the "Organizing Company") is organizing from 12th May 2023 to 4th  June 2023 inclusive, a free competition with no obligation to purchase entitled "Spring Game" (hereinafter referred to as “Game”) in accordance with the terms and conditions set out in the present rules. 

This  Game is accessible through www.playtex.co.uk. from 12th May 2023 at 00:00 to 4th  June 2023 at 23:59 inclusive. It will be shared via a Newsletter on the social networks of the Organising Company (Instagram and Facebook).

The purpose of these rules is to define the rights and obligations of the Organizing Company and the participants in the Game (hereinafter referred to as the "Rules"). 

Participation in the Game implies full acceptance of the Rules by the participants and their application by the Organizing Company. 

For the purposes of the Game, it is  reminded that this operation is neither organized nor sponsored by Facebook or Instagram.

ARTICLE 2: CONDITIONS OF PARTICIPATION

This Game is free and open to any person (hereinafter the "Participant") over the age of 18 as of 12th May 2023 included, who has Internet access, a valid e-mail address and who resides in the UK, with the exception of the staff of the Organizing Company, the members of its family and any person who has been directly or indirectly involved in the design, organization, execution and/or management of the Contest.

It is the Participant's responsibility to ensure that the information communicated is valid, and in particular that the e-mail address is correct. If this is not the case, the possible prize cannot be awarded. It is thus specified that no claim can be accepted if the Participant has indicated an invalid e-mail address, or if he/she is prevented for any reason from reading his/her e-mail. 

ARTICLE 3: TERMS AND CONDITIONS OF PARTICIPATION

This Game will take place exclusively on www.playtex.co.uk, on the dates indicated in article 1 above. 

The products carrying the operation are identified as follows: the Playtex logo, the products of the Playtex collection, the graphic charter of the Game and the brand.

To take part in the Game, the Participant must click either on a widget present on the homepage of the website Playtex.co.uk or on the link provided for this purpose in the Facebook post and the Instagram story or for subscribers to the newsletter via a newsletter sent by the Organizing Company. The Participant will be redirected to the page of the site where the game is located

Participation is strictly personal and nominative. Under no circumstances may the player play under one or more pseudonyms, with several e-mail addresses (regardless of the number of e-mail addresses he/she has) or from a player account opened for someone other than him/herself.

If a participant wishes to withdraw their entry, they can do so by contacting PLAYTEX Brand through its Facebook or Instagram accounts. 

The Organising Company reserves the right to refuse the participation or eligibility of a participant who does not comply with the instructions and conditions of participation indicated in the Rules and, in particular, the articles above. 

The participant is fully responsible for the data and all elements published during his/her participation in the Game and must ensure that they are accurate and do not infringe any third party rights whatsoever. Any entry containing errors, fraud or illegality will not be taken into account and will be considered void. 

ARTICLE 4: PRINCIPLES AND MODALITIES OF PARTICIPATION IN THE GAMES 


4.11     Spring Game : 3x£45 (forty-five), 2x£65 (sixty-five), 1x£130 (One hundred and thirty). All prices are taxes included
    4.11.1 Terms of the Spring Game
The Game takes the form of a Swap & Match. The game consists in making as many combinations as possible in a given time, it is necessary to align vertically or horizontally a minimum of 3 identical elements to eliminate them. A draw will be made at the end of the game by … and prizes will be awarded. The participant will be notified by the Playtex team by e-mail whether or not he/she has won.

        4.11.2 Conditions of the Game
The £45 vouchers have to be used until 4th June 2023 and on www.playtex.co.uk only. They are unique and can only be used on a shopping basket. Vouchers cannot be combined with each other or with any other promotional offer. A person cannot participate more than once in the game, so there will be 6 different winners.
The set needs to be chosen from the www.playtex.co.uk website and depends on available stock.
Codes only available to users who have entered and won the Game. These codes may not be exchanged for payment or provided to a third party under any circumstances.

ARTICLE 5: DETERMINATION OF THE WINNER(S) 

5.1    Designation of the winner(s)

A draw will be made at the end of the game by the Organising Company via Playtex team member.... The winner will be contacted later by the Playtex team to receive his/her prize.

5.2    Elimination from participation / Disqualification 

Participants authorise the Organising Company to carry out all checks on their identity, age, domicile and telephone number in the context of the Game, without however the Organising Company being obliged to carry out a systematic check of all entries. Any participation that does not comply with the Rules, that is incomplete, false or with erroneous contact details shall be considered null and void.

The use of robots or any other similar process to play the Game mechanically or otherwise is prohibited, and any violation of this rule will result in the definitive elimination of its creator and/or user. 

If it appears that fraud, cheating or any abusive behaviour (resulting in particular in cheating or distortion of the Game system) or any violation of the Rules has occurred in any form whatsoever, the Organising Company reserves the right to eliminate the participation of its author, not to award the prizes to the fraudsters and/or to prosecute the perpetrators of such fraud before the competent courts, without being held liable. 

5.3    Notification of the winner 

The winner shall be notified by the Organising Company by e-mail whether or not he/she has won within 5 days following the end of the game/draw, according to the principle of the draw, and the prize shall also be communicated in this e-mail via a promotional code. 

 
The Organising Company shall not be held responsible in the event that the data provided by the winner, in particular his/her email, is falsified and/or erroneous.

 
The winner has to confirm the e-mail address on which the prize has to be sent to by the Organizing company within 5 days of the notification of his/her prize by the Organising Company. If he/shewho does not take possession of his/her prize under the conditions set out in article 6 below, shall be deemed to have purely and simply renounced it. The prize shall not be awarded and may under no circumstances be claimed subsequently by one of the winners, and shall remain the property of the Organising Company.

It is specified that no information will be given orally by the Organising Company.

ARTICLE 6: PRIZES

TheGame is endowed with the prizes set out above and awarded to participants winners of the competitions and declared winners by the Organising Company. 

Each winner wins a single prize.

The prize(s) awarded in the context of the Game have been set out above.

The vouchers and discount codes will be valid for 3 months from the day the prize is won only on the website www.playtex.fr and will not apply to delivery costs. 

The winners will receive their prize by post or by e-mail, at the address indicated in the above-mentioned confirmation, within an 10 days period from the date of receipt of their confirmation e-mail.

The Organising Company shall in no event be held liable in the event of loss and/or piracy of the prize(s). 
Each prize offered is nominative and may not be awarded to another person. Each prize is non-exchangeable and may not be the subject of a cash refund or any other consideration of any kind whatsoever and is non-transferable.

 The value of the prize is determined at the time of drafting the Rules and cannot be contested as to its evaluation. Any photographs or graphic representations of the prizes are provided for illustrative purposes only and may not be considered contractual.

The prize may not under any circumstances give rise to disputes or claims of any kind, nor be the subject of a request for financial consideration, exchange, return or replacement, or transfer to a third party, for any reason whatsoever.

Any other expenses incurred by the winner, in particular for the maintenance of the prize and/or during the period of enjoyment of the prize and/or as a result of its use (such as travel, transport, insurance, etc.), shall be borne entirely by the winner.

The Organising Company shall not be held responsible for the use or non-use, or even the trading, of the prizes by the winners.

In the event of force majeure or if circumstances oblige it to do so, the Organising Company reserves the possibility of substituting, at any time, for the prize, a prize of equivalent commercial unit value and similar characteristics.

ARTICLE 7: DELIVERY OF PRIZES

The winner will know x days after the end of the game by e-mail whether or not he/she has won the promotional codes or vouchers, according to the principle of the draw.

Prizes not delivered or not claimed within the aforementioned period, for whatever reason, shall be considered as remaining the property of the Organising Company, which may freely dispose of them.

ARTICLE 8: RULES

Participation in the Contest implies full and unreserved acceptance of the Rules by the participants. 

The Rules can be consulted at www.playtex.fr until the end of the Game as indicated in article 1 of the Rules and throughout the duration of the Game. 

The Organizing Company shall make its best efforts to ensure that the offer is accessible on the Internet 24 hours a day directly at the address www.playtex.co.uk, without being bound by any obligation of result.

The Organizing Company reserves the right to extend, shorten, modify or cancel the Game at any time, and in particular in the event of force majeure, without the participants being entitled to claim any compensation. 

Any modification will be the subject of an amendment, published on the Organizing Company's website at www.playtex.co.uk.

No requests or telephone complaints concerning the application or interpretation of the Rules by a participant will be answered. Any dispute or claim relating to the Contest and/or the methods of designating the winner(s) in the context of the Contest must be made in writing to the address of the Organising Company indicated in article 1 of the Rules, no later than thirty (30) days following the close of the Contest. 

ARTICLE 9: RESPONSIBILITY

Participation in the Game implies knowledge and acceptance of the characteristics and limits of the Internet network, in particular as regards technical performance, response times for consulting, querying or transferring information, the risks of interruption, the risks associated with the connection, the lack of protection of certain data against possible misappropriation and the risks of contamination by any viruses circulating on the network. The Organising Company may not be held liable in particular for malfunctions that may affect the Internet network, for any configuration problem or problem related to a given browser, or for hacking into the Participant's e-mail address. 

The Organizing Company does not guarantee that the Internet site and/or the Game will function without interruption, that they will not contain computer errors or that any defects noted will be corrected. 
The Organizing Company shall not be held liable in the event of technical malfunction of the Game, if Participants are unable to connect to the Game site or to play, if the data relating to a Participant's registration does not reach it for any reason for which it cannot be held liable (for example a problem with the Internet connection due to any reason whatsoever on the part of the Participant) or arrives unreadable or impossible to process (for example, if the Participant has inadequate computer hardware or software environment for registration) or in the event of problems with the delivery of electronic mail. Participants may not claim any compensation in this respect. 

In the same way, the Organizing Company shall not be held responsible for any damage, material or immaterial, caused to the Participants, their computer equipment and the data stored therein, or for any direct or indirect consequences that may arise therefrom, in particular on their personal, professional or commercial activity. 
The use of robots or any other similar processes that would make it possible to improve the capacities/results of the options offered by the application in a mechanical or other way is prohibited, and the violation of this rule will result in the elimination of its author, for the entire duration of the Contest. 
In this respect, the Organizing Company may cancel all or part of the Contest if it appears that fraud has occurred in any form whatsoever, in particular by means of computerised participation in the Contest or by means of an automatic system designed to modify participation and/or the results of the Contest. In such a case, the Organizing Company reserves the right not to award the prizes to the fraudsters and/or to prosecute the perpetrators of such fraud before the competent courts. 

The Organizing Company also reserves the right to stop or suspend the Contest in all cases where, for whatever reason, the computer system awards prizes not provided for in these rules. In such cases, the messages informing the Participants of a prize will be considered null and void. In no case may the number of prizes exceed that provided for in these rules.

ARTICLE 10: LIMIT OF LIABILITY

The Organizing Company shall not be held liable in the event of force majeure or for any event whose origin is external to it. Nor shall the Organizing Company be held liable for problems inherent in the Internet connection or the poor delivery of mail or for any other problem, in particular technical problems, which are not attributable to it and which occur during the Game and at the time of participation and/or the awarding of the prize and/or which prevent the proper running of the Game and the participations. 

If the winner's contact details are incorrect, inoperable or if the winner cannot be identified by name, address or telephone number, it is not the responsibility of the Organizing Company to make additional searches in order to find the unavailable winner, who will therefore not receive his prize, nor any compensation or indemnity.

The Organizing Company declines all responsibility for any incidents or accidents, direct or indirect, that the winner may suffer during the use and/or enjoyment of the prize.

The Organizing Company also reserves the right to cancel, interrupt or suspend all or part of the Contest if it appears that fraud has occurred in any form whatsoever, in particular in a computerized manner, in the context of the administrative and/or technical conduct of the Contest, participation in the Contest and/or the determination of the winners. 

Each participant declares and guarantees that he is the sole owner of all intellectual property rights to the comment(s) published or communicated to the Organising Company in the context of the Contest and, in general, that such publication(s) do not infringe on any third-party rights whatsoever and undertakes to comply strictly with Facebook's general conditions of use and privacy policy.
ARTICLE 11: FORCE MAJEURE

The Organizing Company shall not incur any liability if, in the event of force majeure, it is forced to cancel the Game, to shorten, extend, postpone or suspend it or to modify the conditions thereof. 

In any case, it reserves the right to extend the participation period.

ARTICLE 12: PROCESSING OF PERSONAL DATA

Within the framework of the Game, the winners communicate to the Organizing Company personal data concerning them, namely name, first name, email (hereinafter referred to as the "Personal Data").

The person responsible for processing the Personal Data is the Organising Company.

The Data Protection Officer is Mrs. Kenia Denoyès, who can be contacted at the following address: global.privacy@dim.com, or at PW France, 2 rue des Martinets 92500 Rueil-Malmaison.
 

By providing the Organising Company with this Personal Data as part of his/her participation in the Game, the participant expressly agrees that it may be collected, recorded, used and be subject to computer processing, under the conditions defined below. The processing is subject to European Regulation 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (known as the "GDPR") and to the French Data Protection Act of 6 January 1978 in its latest version in force.

This Personal Data is intended for use by the Organising Company and its technical service providers for the purposes of organising the Game within the framework of the Rules and for awarding the prize(s). The Personal Data shall not be assigned or transferred to entities other than those referred to in this paragraph. The technical service providers undertake to destroy the data collected at the end of the management of the Game. 

The collection and processing of Personal Data is necessary for the purposes of
- The taking into account of entries; 
- the management and organisation of the Game, in particular to identify participants, determine the winner(s) and subsequently award prizes; 
- commercial canvassing, i.e. to enable the sending of information, in particular commercial information from the Organizing Company and from any DIM brand products, such as newsletters, new offers or news.


The Personal Data collected shall be kept by the Organising Company :
- for all the time necessary to award the prizes to the winners;
and
- for a period of 3 months from the end of the Contest, unless the participant expressly agrees at the time of participation in the Contest to receive commercial information from the Organising Company thereafter.
In accordance with the legislation in force, participants have the following rights with regard to their Personal Data
- right of access ;
- right of rectification and deletion; - right of access
- the right to limit the processing;
- right to data portability;
- right to deletion and opposition;
- right not to be subject to a decision based exclusively on automated processing;
- the right to withdraw your consent to the processing of your personal data, without prejudice to the lawfulness of the processing based on the consent given prior to the withdrawal of consent; 
- the right to set out instructions on what to do with that data after your death; and
- the right to lodge a complaint with the Commission Nationale de l'Informatique et des Libertés ("CNIL").

Participants may exercise any of these rights at any time by writing to the attention of Ms. Kenia Denoyès at the following e-mail address: global.privacy@dim.com, or at the postal address PW France, 2 rue des martinets, 92500 RUEIL MALMAISON, France. The request must be accompanied by any means allowing to prove the identity of the concerned person and indicate the name, first name and e-mail or postal address. The Organizing Company may, at any time, request additional information in order to confirm the identity of the applicant.

The Personal Data collected are essential for participation in the Game. Participants who exercise their right to delete and erase their Personal Data before the end of the Contest shall be deemed to have waived their participation. Participants may, in any case, object, without any reason, to their Personal Data being used for commercial prospecting purposes.

ARTICLE 13: APPLICABLE LAW AND DISPUTES

These General Terms and Conditions of Sale and the contractual relationship between the Client and PW France shall be governed by and interpreted in accordance with French law and any legal dispute shall be handled by the competent French Court.

In the event of any dispute relating to these GTC and/or the existence, interpretation, performance or breach of contract between PW France and the Client, an amicable solution shall be sought before any legal action is taken. It is specified that the prior attempt at an amicable solution shall in no way interrupt the legal warranty period.

As a member of the French Federation of E-commerce and Distance Selling (FEVAD), PW France is required to comply with the general principles and rules set forth in the FEVAD codes and charters.

In the event that the Customer's request for a complaint to the PW France customer service fails or in the absence of a response from this service within a period of two months, the Customer may also refer the matter to the FEVAD mediator for any complaint concerning the sale of a product purchased on the Site, subject to compliance with the conditions for admissibility of the request. To find out about these conditions and to contact the mediator, the Customer may visit the FEVAD website at the following address: www.fevad.com.

The Customer may also visit the European Consumers Centre cooperating with the UK International Consumer Centre.

Any dispute relating to the interpretation, performance or breach of contract concluded between the Client and PW France, even in the event of multiple defendants, shall be submitted to the competent courts in the absence of an amicable agreement.
